Del. Admin. Code tit. 5, § 2103.1. Mortgage Loan Broker Regulations Itemized Schedule of Charges

1.0 Notification 
Every licensee shall make available for review to every applicant, a copy of this regulation at the time when such application is made. Posting of this regulation in the office of the licensee in a place both prominent and easily visible to all potential applicants shall satisfy this requirement. An explanation as to the contents and limitations contained herein shall satisfy this requirement when transactions occur telephonically.  
2.0 Fees Permissible for Collection Prior to Receipt of a Written Commitment - In connection with the application for credit and on behalf of the borrower, the following fees subject to the limitations enumerated herein may be collected prior to the receipt of a written commitment from a bona fide lender:
2.1 Property appraisal fees shall be limited to the amount paid to a third-party for such appraisal and shall be limited to those amounts that are customary and reasonable;
2.2 Credit report fees shall be limited to the actual cost of the report, the amount of which was paid to a third-party. Such amounts shall be customary and reasonable;
2.3 Title examination fees and/or title insurance shall be limited to those amounts actually expended for such purposes. Such amounts shall be customary and reasonable;
2.4 Returned check charges may be assessed to consumers, provided the amounts of such charges are customary and reasonable for checks that are returned unpaid;
2.5 Other bona fide third-party fees actually and reasonably paid or incurred on behalf of the borrower. Such other fees shall not be incurred without the express permission of the borrower and shall be limited to amounts actually paid or incurred. Such amounts shall be customary and reasonable;
2.6 An application fee may be imposed in lieu of the fees itemized above (excluding item 2.4) provided the amount of such application fee reasonably reflects the anticipated amounts of all appropriate fees and amounts collected in excess of such actual costs shall be refunded. Those fees which reasonably exceed the anticipated amounts shall be payable by the borrower.
2.7 Fees associated with the commitment of a specific interest rate, to be held for a specified period of time, may be collected in accordance with a signed rate lock agreement, provided the fees are payable to the lender.
3.0 Fees Permissible for Collection Upon or After Receipt of a Written Commitment or Pre-Approval and Prior to Consummation of the Mortgage Loan
3.1 Fees associated with loan commitments, if such fees are required by the lender upon receipt of a written commitment, provided the fees are payable to the lender.
3.2 Fees that the lender may require in advance of a loan closing, provided, however, that such fees are paid directly to the lender or third-party provider.
3.3 This section shall not prohibit the collection of fees otherwise permitted under item 2 of this regulation, if such fees are collected after receipt of a written commitment or pre-approval.
4.0 Collection of Fees in the Name of the Mortgage Loan Broker - Notwithstanding the limitations under items 2.7 and 3.0, a mortgage loan broker may collect the fees authorized in items 2.7 and 3.0 of this regulation, in the mortgage loan broker's own name, if required by the lender.
5.0 Fees for Mortgage Loan Broker Services - A fee may be collected from a bona fide lender, in accordance with the mortgage loan broker agreement, at closing or following the recessionary period (for loans which qualify for rescission under the Federal Truth-in-Lending Act). In no event shall the aggregate points charged to the borrower exceed ten percent of the principal amount of the loan. Such point limitation shall apply to points assessed by the lender on the lender's behalf, together with points charged by the lender on behalf of any other party to the transaction. The total compensation paid to a mortgage loan broker shall reasonably reflect the value of the goods and services provided.

If presented, this agreement will highlight (1) the term and principal amount of your loan; (2) an explanation of the type of mortgage loan being offered; (3) the interest rate that will apply to the loan and, if the rate is subject to change, or is a variable rate, or is subject to final determination at a future date based on some objective standard, a specific statement of those facts; (4) the points and fees, if any, to be paid by you; and (5) the term during which the financing agreement remains in effect.

This agreement dated as of the date you submit your loan request and is valid until canceled. For loan request information, including you name, the requested loan amount, lien priority, and the date of your request, please see your loan request form displayed prior to the submission of your loan request, which is incorporated herein by reference. For interest rates and fees applicable to your loan request, see the lender responses to your request. iHomeowners does not have any involvement in the setting of interest rates and fees on your request. Please print and retain a copy of this agreement and the loan request form for your records.

Escrowing of Consumer Funds
iHomeowners does not accept any fees from the consumer, including third party fees.

Consumer Protection Bond
A consumer protection bond is on file with the State of Maine. If you have a claim against our company which cannot be resolved through informal means, you may institute an action to recover your loss from that bond by filing a written complaint with the Director, Office of Consumer Credit Regulation, 35 State House Station, Augusta, Maine, 04333-0035

New York Mortgage Broker Disclosure
You have advised me that you are authorized and prepared to assist me in securing financing. I understand that your services may include, but are not limited to, the following: (1) counseling on available mortgage products; (2) counseling on general mortgage qualification procedures and requirements; (3) counseling on my financial capabilities; (4) assistance in obtaining information required to complete the mortgage application; and (5) assistance in processing the loan application, and in meeting conditions of the loan commitment.
I hereby agree to engage you for the purpose of advising me about financing and to provide the services described above.  This agreement will continue until the earlier of the declination of my loan request, the closing of my loan or my termination of your services.

I acknowledge that prior to paying any fees or completing any application, I was advised of the following: (1) your services are advisory and administrative in nature; (2) you are not authorized to make mortgage loans or commitments; and (3) you cannot guarantee acceptance into any particular loan program, nor can we promise any specific loan terms or conditions.

I understand that, as compensation for your services, you will receive a loan origination fee of up to $0 upon the closing of my loan. I acknowledge that this fee will be paid to you by the Lender outside of closing. The compensation you will receive from the Lender for your services is included in the rate, points, fees and terms of the loan as quoted by the Lender in its commitment.

Fee Acknowledgment: I acknowledge that this loan origination fee will be paid to you. I further acknowledge that there is no other fee agreement between us.   If required by the Lender, I may have to pay a loan application fee and credit report fee. The Lender will determine the amount of this fee. The Lender's policy, not yours, determines if the fee is refundable. If the fee is refundable, the Lender will tell me the conditions for obtaining a refund.

iHomeowners will be receiving a fee or other compensation from the lender for arranging the loan. The fee will be not more than 0% of the loan amount.

Prospective Borrower(s) and iHomeowners agree to the above terms and conditions.  Prospective Borrower(s) authorize(s) the release of all information required by lender relating to the disposition and status of the mortgage application.
You agree to the above terms and conditions, you authorize Lenders to request your consumer credit report, and you authorize the release of all information required by the lenders relating to the disposition and status of your loan request, and, at your written request, you will be informed whether or not a consumer report was requested, and if a report was requested, you will be informed of the name and address of the consumer reporting agency that furnished the report.

iHomeowners is an internet marketing company and does not accept applications from consumers. Rather, iHomeowners matches consumers with mortgage brokers, lenders, or bankers.  Consumers contact iHomeowners, provide certain information, and a loan request is forwarded to participating mortgage brokers, lenders, or bankers.  The consumer will be contacted by multiple participating mortgage brokers, lenders, or bankers. The consumer has the option of selecting one of the participating mortgage brokers, lenders, or bankers and providing certain additional information which constitutes an application. The mortgage broker, lender, or banker provides the appropriate disclosures to the consumer. iHomeowners, Inc. does not charge the consumer a fee of any kind for the use of the service. iHomeowners, Inc. may receive a flat fee from the mortgage broker, lender, or banker whether or not a loan is completed. iHomeowners, Inc. does not make mortgage loans or credit decisions.

If your loan request is forwarded to one or more participating Lenders you may receive from the Lenders a good faith estimate of settlement costs under RESPA and an initial disclosure statement required under the TILA.

The interest rate quoted in connection with the loan you select is subject to change without notice unless and until an interest rate lock-in agreement has been made between you and the Lender. iHomeowners does not offer lock-in agreements and does not guarantee any rate of interest quoted by a participating Lender. If you enter a lock-in agreement with the Lender and are required to pay a lock-in fee, the terms and conditions under which the lock-in fee may be refunded, if any, will be set by the Lender.
We will not collect any fees from you in connection with your completion of a loan request. All fees will be collected by and payable to the Lender. If the Lender is licensed under the Mortgage Broker Practices Act, the fees paid by you for third-party provider services (such as an appraisal or credit report), may be held in a trust account and any moneys remaining after the payment to third-party providers will be refunded to you.
If you are unable to obtain a loan for any reason, the Lender, if licensed under the Mortgage Broker Practices Act, will, within five (5) days of a written request by you, give copies to you of any appraisal, title report, or credit report paid for by you, and transmit the original appraisal, title report, or credit report to any other mortgage broker or lender to whom you direct. Transmission of these reports includes the right to use these reports. You are also entitled to receive a copy of any appraisal paid for by you, pursuant to the federal Equal Credit Opportunity Act. 

Washington state law against discrimination prohibits discrimination in credit transactions because of race, creed, color, national origin, sex or marital status. The Washington State Human Rights Commission administers compliance with this law.
